1. WHO WE ARE
This website, potifiv.com, is operated by Fivbes LLC, a Wyoming limited liability company trading as Potifiv ("Potifiv", "we", "us", "our"). Registered address: 30 N Gould St Ste N, Sheridan, WY 82801, United States. Contact: hello@potifiv.com.

By visiting this website or buying from us, you agree to these Terms of Service ("Terms") and to the policies they reference, including our Refund Policy, Shipping Policy and Privacy Policy. If you do not agree, please do not use the website. Our store is hosted on Shopify Inc.

2. ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority where you live to place an order. You agree to give accurate, current and complete information when you order or create an account, and to keep it up to date. You are responsible for activity on your account and for keeping your password secure.

3. PRODUCTS, IMAGES AND COLOUR
We sell design-led home décor, including terrariums, pendant planters and related parts. We make every effort to show our products accurately. Some lifestyle and scene images are digitally composed or rendered to show a product in a setting, and props, plants, rooms and lighting shown are for illustration only and are not included unless stated in the product description. Colours can vary slightly between screens and between production runs. Product dimensions and what is included are stated on each product page, and the product page governs if an image differs.

Live plants are not included unless a listing says so. Our products are decorative and are not toys. Hanging products must be installed to a secure ceiling fixing suitable for the weight, following the included instructions. You are responsible for correct installation.

4. PRICES AND PAYMENT
All prices are shown in the currency displayed at checkout. Prices, promotions and availability can change without notice, but a change will not affect an order we have already accepted, except in the case of an obvious error (see section 5). Payment is taken at checkout through our payment providers. We do not store full card details.

5. ORDERS, ERRORS AND CANCELLATIONS
Your order is an offer to buy. A contract is formed when we confirm dispatch. We may refuse, limit or cancel any order, including orders that appear to be placed by resellers, orders with suspected fraud, or orders affected by a pricing, description or stock error. If we cancel an order you have paid for, we will refund you in full.

6. SHIPPING, DUTIES AND TAXES

International orders (outside the United States) are shipped Delivered Duties Unpaid. Import duties, taxes and brokerage fees, if charged by your country, are not included in our prices and are payable by you on delivery. If a parcel is refused or abandoned because these charges were not paid, we may deduct the return shipping cost from any refund.

Risk of loss passes to you on delivery to the address you provided.

7. RETURNS AND REFUNDS

If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you have a statutory 14-day right of withdrawal. Nothing in these Terms limits that right. See: https://potifiv.com/pages/withdrawal

8. WARRANTY

Except as stated there, and to the fullest extent permitted by law, products and the website are provided "as is" and "as available" without other warranties of any kind, express or implied, including merchantability and fitness for a particular purpose. Nothing in these Terms affects any statutory rights you have as a consumer that cannot be excluded by contract.

9. INTELLECTUAL PROPERTY
Potifiv is a trademark of Fivbes LLC. All website content, including text, photographs, renders, graphics, logos and product designs, belongs to Fivbes LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, sell or exploit any of it without our written permission.

10. REVIEWS, PHOTOS AND OTHER SUBMISSIONS
If you send us reviews, photos, ideas or other content, you confirm you have the right to share it and you grant us a non-exclusive, royalty-free, worldwide licence to use, display and adapt it in connection with Potifiv. We will ask for your permission before featuring your photos in marketing. We may remove any content that is unlawful, offensive or that infringes anyone's rights.

11. PROHIBITED USES
You may not use the website to break any law, infringe anyone's rights, submit false information, upload malicious code, scrape or crawl the site, interfere with its security, or harass or harm others. We may suspend or end your access if you do.

12. THIRD-PARTY SERVICES AND LINKS
The website may link to or use services run by third parties, such as payment providers, carriers and social platforms. We are not responsible for their content or practices, and your use of them is subject to their own terms.

13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fivbes LLC and its owners, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the website or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow these limits, so they apply only to the extent the law allows.

14. INDEMNITY
You agree to indemnify and hold harmless Fivbes LLC from claims, losses and reasonable legal fees arising from your breach of these Terms or your misuse of the website or our products.

16. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute will be handled by the state or federal courts located in Wyoming, unless the law of the country where you live as a consumer gives you the right to bring a claim in your local courts. Please contact us first, most issues can be resolved quickly by email.

17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version posted here, with its "Last updated" date, applies to orders placed after that date.

18. GENERAL
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and us about your use of the website and your purchases.
